Popeye Posted April 12, 2008 Posted April 12, 2008 Been thinking about the wording of that cited law - it's VERY possible that you might be able to convince a judge that you thought that it meant no more than one line in the water at a time with one hook point, not one line with multiple hook points which is how it reads. Ambiguity in the law is a no-no and often used by defense attorneys to have cases thrown out of court/dismissed. As far as due respect to GWs as law enforcement officers - they are entitled to that, IMO. However, YOU are also entitled to DUE respect from them as well. Any abusive attitude or mannerism by any law enforcement officer should be reported to his/her superiors immediately. Unfortunately, it often comes down to "his/her word against your's" and superiors/judges generally side with the officer. I know in Coronado, CA I refer to the police as the "Coronado Gestapo".

They patrol borders and encounter some illegals crossing and smugglers. One of the most dangerous jobs in Texas. Sorry for his ticket, but your statement about Barney and Game Wardens are off course. Hookem Bravo Matty. I live in RI and I am aware of the j-hook laws in NY, they are there to protect the salmon from "snaggers". It's a good law that is strongly enforced,.......for the benefit of the fish and fisherman. Take it as a lesson and spread the word, now you know

RichardE Posted April 12, 2008 Posted April 12, 2008 If you find the citation is covered in the regs book as it appears to be, you may consider going to the prosecuting attorneys office prior to your court date and talk with him/her. They may be able to work with you on the appearance, unless you want to challenge it. As mentioned above, if that rule is applicable in that stretch, they probably do look for that violation. I think ignorance of the law will not help in court, the judge will smoke you. Be careful in dealing with the judge, they hear a lot of stuff and can most can see through steel. A conversation with pros. may help, also you can get the case continued/rescheduled to accomodate your school schedule if you ask. Good luck. bigdog Posted April 12, 2008 Posted April 12, 2008 .I find it alarming that a few on the forum think it's ok for them to break the laws on places posted no fishing OR not knowing the regulations concerning lures or baits. I give those that do this pratice no symphathy what so ever you deserve what you get for breaking the law. so you've never knowingly ran a stop light or sign? how about gone over the speed limit? a law is a law and everybody has broken one at one point in time or antoher. Also everyone makes mistakes with is what seems to be the case with the original poster, so why dont we cut him some slack? but you don't here me crying about it on a forum.the problem with cutting him some slack is he's old enough to know the law like I know not to speed or park in a no parking zone or make wake in a no wake zone the list goes on and on ... :'( :'(

I will say this, One day you will need help from one of those guys...maybe directions or saving your life. I am proud those guys patrol our waterways and woodlands.

He kept calling me in to check my PFD's ,air horn, registration and fishing licence. I was getting upset and i got into a bit of a verbal, I explained sometimes he is whistling and waving me in hundreds of yards away, and with a trolling motor a stop like that can cost you an hour. He was a bit I am the law, until finally i saidd Look I am here about a 100 times a season, you think you would get to know my boat and i obey all the laws. He said your state registration numbers are posted wrong on the left side of your boat. Later that day we both said sorry, and this year I have the letters legally sapced, Was a bad day for both of us Conversley I found a trot line with 2 dead catfish and several bass, they are illegal herwe. He sat there well after his shift and collared the guys when the came for it.

You can decline, but it will save you time in the long run. They give you a sticker that you can put on your boat but I never do. Not illegal. That puts me at risk for an on the water check. That would cost me time but I am not putting a sticker on my boat that I have to change every year. My choice. My brother in law has been warned because he has scripted registration letters and numbers. Very minor offense. He hasn't changed them, that puts him at risk for a ticket and inspection. His choice.

NY you mook,......many people who are not from New england, think RI is a part of NY. YOU live here,...you should know the difference ;D Rooster, your complaints are justified if you are doing something about it. Your community is the only group that can stand up for itself. If you are not part of the solution, then just complaining about it gets you nowhere and makes you part of the problem, not the solution. Please don't group all law enforcement as scum just because your local town has opted to settle for such.

I think based on your description of events surrounding the ticket that the guy was being a grade A, #1, pure @$$hole. Another perfect example of what I was describing above, he'd fit right in on the force around here where I live. So try and wiggle out of your responsibility when you are point blank wrong? That's no lesson for a kid whether you respect your law enforcement or not. As for the guy being a jerk,....If you knew how serious of a situation this is on certain parts of certain rivers in NY, you'd understand that he probably feels the same about a guy who comes to a section of a river that is so abused it has a warden there 24/7, and blatantly used the method he is specifically put there to enforce. These guys are not the typical ego based cop, they are there protecting a fishery that the PUBLIC has abused. This is the equivelant of smoking a joint on the steps of the police station and then calling the cop that arrested you a jerk. Knowing the law is your responsibility.

It just does not get any worse than this. Hey, I guess the guy was having a slow day. This is a new one on me. And I agree, get the fishing regulatinos, look them over, and if you messed up just apologize to the judge and hope he will give you a warning. Be sure to dress nice for court. A coat and tie is a nice touch. Dress like a Wall Street banker. Show respect and humility and don't be a smast ***. Otherwise, it is in the pokey for 5 years.
