I see this several ways...

1) if it was easily erasable marker then get a paper towel and clean it off, no harm done

2) the teacher/principal/school overreacted

3) if it was permanent or carving or something else, then detention or a visit to the principal is all that is needed. Hell when I was in high school anyone caught defacing the desks got detention in the arts lab where they sanded, used filler and repainted the desks (under VERY close supervision) or faced suspension. Good thing I was never caught  8-)

They over reacted, to place her under arrest for something so silly. Did you guys read down where it says a 5 year old was taking to a psych ward for acting out in class. WTH, what's wrong with the schools today. Did they forget their just kids, being immature is their nature.

Yea i totally feel this is all WAY WAY overreacting... A simple detention is all that should be given AT MOST. If it were me as the teacher id just make the person clean it off and tell them to not do it again and all is well.

Very happy that this kinda crap isn't happening in my schools. Considering the class my friend and i read this in, is where a few of us have contests on the best desk art we can draw. 1/2 of the desks in that class have drawings lol.

I agree with this as well.....I don't know her parents,but i do know most parents are crappy parents nowadays and kids get away with a lot of stuff than we did back in the day.

How many times do we hear kids doing stuff and just getting a slap on the hands instead of paying the

consequences? Or worst yet the school gets "sued" because they tried disciplinary action?

Was it overboard? Maybe...but i bet it taught her a dang good lesson and she won't do it again.

The 5 year old story is a different one...One i won't agree with.But this girl wasn't 5 years old....

A 12 year old in handcuffs for a non violent crime..........Glad to see a class action suit by the NY civil liberties union, I'd be calling for dismissals from both school and police.

I think both the teacher and principal need to issue an apology to the girl and her family. And the police that actually followed the order need to learn some common sense. What a bunch of fuggin' idiots. If I was the girl's parents I be raising all kinds of hell.

Now, if the girl was at school in after hours painting on school building or something, then yeah she deserve be arrested for vandalism. But an erasable marker on a desk that probably extremely smooth and easy to clean..what the hell?  :-? Even if the marker was permanent and it still never came off, then girls parents should be contacted and be obligated to pay damage. In my school system I witnessed several minor vandalism in which school took action without police and no one did it again...
