I still stand by my statement, a simple task perform by a manager or an honest employee would have prevented this. I've seen at it K-mart. Some people would buy something, go back to electronic grab a 20" LCD TV and try carry it out the door while some employee would just see the receipt and let them walk out the door. It didn't happen at my store, but the loss and prevention manager told me it happen at other stores and he told me when someone shows you a receipt, read the dates and the items. All I'm saying is, if employees knew how do their job they wouldn't be having this problem. Quote

To me, that thinking is akin to saying that because someone forgot to lock their doors then it it their own fault someone stole their stuff. How about if I let my Antivirus software lapse for a month and someone steals my bank information? Is that not a crime? Many thefts can be prevented and big box stores do little to curb the practice, however it is still wrong. Honestly, I dont see any other valid perspective. To me, rationalizing his actions by placing blame on store employees is criminal thinking. Quote
CanalStalkin Posted December 21, 2009 Posted December 21, 2009 I see where rootbeer is coming from. I have seen people pull some SCANDALOUS moves at walmart and have even pointed some out to workers who have done something about it. Alot of stores need to pay more attention to stuff like this, but I also think he should be dealt the maximum penalty for it since its flat *** stealing. Thats like people complaining about "baiting", like baitcars and such. Jesus, they are still stealing something that isn't theirs! Doesn't matter if it was parked with the keys in it. Quote

Super User Gone_Phishin Posted December 21, 2009 Super User Posted December 21, 2009 I, like others, was going to keep my mouth shut. After reading various fishing forums, visually seeing his mugshot from a previous theft arrest, etc., it's obvious this is the same guy. The more I think about it, the angrier I get. As many have said, he had no problems involving dozens upon dozens of innocent people in this scam. He's obviously been doing this for some time, and it's obvious he never showed any guilt or remorse for his actions; he continued selling hot gear up to the end. I feel like a creep, because I vouched for him when questioned on the Flea Market pages. What a d-bag. Seriously. This guy has a nasty ball of karma on his back. Quote
Uncle Leo Posted December 21, 2009 Posted December 21, 2009 I also have thought about this and one thing I find odd is everyone's surprise. I always wondered what his deal was, it seemed odd to have so many new in package items. He always was slow to respond but was very respectful and apologetic in his responses when he did. I never bought from him as I knew in my heart this was just not right, but had no idea what the deal was but it seemed like "It feel off the truck" type deal. I wish his family well as it appears this man has a tough road ahead of him. Quote
Super User Root beer Posted December 21, 2009 Super User Posted December 21, 2009 Well Root Beer, you go right ahead an use that defense in front of Judge Judy and tell us how that works out for you. ;D As a matter of fact, I would. I'm pretty sure there is a law where the lawyer can request the D.A. to hand over every single evidence they have on the defendant. Therefore, if they have no actual proof (that video wasn't clear enough) that I put clearance stickers on the merchandise, they cannot prove that I deceived them....I'm sure they got better video than what was posted, but I would make sure the evidence they have is not clear enough before making that argument. I'm sure they got at least one clear video, otherwise, how in hell can they accuse him of it? If it just one video I'm sure the charges and sentence would be reduced. I'm not saying K-mart is better than Wal-Mart, but it clearly the clearance system is. The managers at K-mart do not put clearance price into the computers, nor do they create a new UPC for it. (least my store they didn't), therefore, this required a management check the merchandise with his/her price computer, it did create time lags, but on other hand no one scammed us with clearance tags. I guess to K-mart's managements thought that was better than caring about whether customer thinks they spend way too much time in check out line. Major different between K-mart and Wal-Mart is the layaway. K-mart uses Layaway, Wal-Mart use credit card. Layaway for those that cannot afford the credit charges. Sears holding does offer credit card, but no one seems to be interested in them. Quote
-nick- Posted December 21, 2009 Posted December 21, 2009 I still like Walmart better. I haven't been to K Mart in a while I think the one around me was closed down. It was probably just the store near me but I felt like I was in the ghetto even when I was just in the parking lot. I do like places that do layaways though I wish more places did that. Anyways I hope he does time and comes out a better person after. He was very quick to hand out advice. I know he shopped at BPS too though because he had recommended me some lures that you could only find at bps. So surely he's ripped bps off of plenty of money as well. Quote
Super User J Francho Posted December 21, 2009 Super User Posted December 21, 2009 I'm pretty sure there is a law where the lawyer can request the D.A. to hand over every single evidence they have on the defendant. Its called discovery, and I'm fairly certain there is MUCH more evidence than the single video that the news released, considering the total value of stolen merchandise. Quote

He got busted back in May for "Theft of Property" ( http://justice.dentoncounty.com/isapi/UVlink.isa/dentonco/WEBSERV/JailSearch?action%253Dview%26track%253D236420225 ) so I'm quite sure the PD already knew what he was doing, and have been compiling evidence for quite a while. They didn't just pluck that $19K figure out of the air. As far as the store being partly to blame because they minimum-wage cashier didn't question the clearance prices, that's absolutely ridiculous. My local BPS, for example, has hundreds of rods in stock at any given time with prices ranging from ~$20 to over $400. Do you really expect the teenage girl behind the register to be able to tell the difference between the highest and lowest price rods when half of the members here couldn't do it if you covered the rod's brand label? Now, think about the thousands of other items these retailers stock and the different price ranges. Do you think your wife/mom/daughter/grandmother/aunt could tell the difference between a $15 LC and a $2 Matzuo? I highly doubt it. Quote

Super User ww2farmer Posted December 21, 2009 Super User Posted December 21, 2009 Whats really been bugging me about this, is I told a bunch of co-workers about the whole ordeal...........and most of them thought he did nothing wrong!! I never lock my truck at work, but I did today, and I know I 'll keep my mouth shut on what kind of tackle I buy, and be very carefull whom I have on my boat or in my home. Quote

It's as bad as Bass Pro and their internet prices. That is false. I know, I dealt with it. Most of that problem had to do with shelf saying it on sale, and the employee that was suppose take the sign down didn't. At my store, if the sales ad was for the current week, the item showed up on computer every time. Most people either don't read the ad, or an employees made a mistake on putting the shelf tag on wrong item. It was either customer couldn't read, or employees made a mistake on what is on sale and what is not. Or the sale expired while the sign was still on the item. Heck, one guy actually gave me a news ad for half of crap he had, and was wondering why he didn't get the sales price for it, and the news ad was expired by two weeks. That wasn't a computer error. There was a rare time where the sales ad was current week and an item was not ringing up on sale, however, I had that information on hand that it was suppose be on sale, there was a mistake in computer somewhere, and when I did the price change it worked without manager approval. Number one reason why stores perform poorly is communication, the second reason is lack of work ethic. I was 17 and 18 years old dealing with customers over the price. Hell, one guy asked me if he could have TV 500.00 off since it was last one we had. I told him, "no, I'm trying make a profit here." He did reported me to manager for saying that to him, but come on, man, this is retail not a car dealership. I was reported to manager 4 times, only written up once and that had to do with me coming up short on cash register I signed off on. Whoops. Oh well, life goes on. Quote

I'm just speaking from the store that I'm familiar with, which is basically a step or two above a consignment shop. I honestly don't know why it's still open. They are constantly understaffed, with the exception of electronics, which is where my brother worked, they would have 2 people in electronics and 3-4 for the rest of the store, usually only 1 cashier. I would venture to say that, at least from the local store, it's lack of work ethic. I just thought it was odd that they told him to only use the sale price if the customer brought it up. Quote
