BD means Broke(Richard) South Florida Sun-Sentinel.com Panhandle burglar dead: His gun was fake, homeowner's gun real The Associated Press 4:36 AM EDT, July 23, 2009 BRISTOL Authorities say a burglar with a fake gun was shot and killed by a Panhandle homeowner with a real gun. The Liberty County Sheriff's Office reports that 24-year-old Octavious Barnes broke into 82-year-old Bradley Harvil's home and tried to steal about $1,100 in cash Sunday night. Authorities say Barnes was waiving around a toy pistol, colored black with a marker to look real, and assaulted Harvil. The homeowner was able to get to his real .357 magnum and shot Barnes in the chest and in the eye. Authorities later concluded that three women had helped Barnes plan the burglary. Deputies have charged 19-year-old Jessica Nicole Long, 22-year-old Heather Marie Ammons and 43-year-old Mandy Allen with felony home invasion and second-degree murder. In this case, the crime was conspiracy to commit armed robbery. The girls were part of the conspiracy so the death in the process is also attributable to them. Quote

Homeowner had no way of knowing the gun was fake and I believe the law recognizes that. That's why they put the orange markings on toy guns, to distinguish them from real guns. When the criminal altered the gun, he changed the status from fake to real. Quote

EXACTLY... as far as the law is concerned he was armed, just like if you are found concealing a toy weapon by a law enforcement officer, it still seems real in the situation Quote

There is no accountability for actions. This guy broke in with what appeared to be a gun. He deserved everything he received. Personally gun or no gun,you break into a house to rob or harm somebody you deserve to be killed. Eventually there would be no more break-ins. Quote
