I'm confused.  If the home was left to you and your siblings you are a part owner and must consent to any sale.  Plus, recieve your share of the proceeds of any sale.  How can someone sale something you own and you not benefit?

Hospital and bank were owed money by my mom ,my brother is executer of estate we do get 3rds but all happened so fast since it is going to be a cash buyout >And brother and sis want money bad .If i hadnt signed house woulda went to forclosure soon anyhow>My familey changed after my mom passed ,its sad no communication except this kinda stuff.I knew it was coming but so fast >:(:o.The woman buyin it had some lawyer write this "house has to be vacant" before bought BS .Its very hard times now to sell. House was appraised at 170 a yr ago down to 120 on over a acre ,so now they are getting the house as a bonus 70 yr old house aint worth much.Im still optimistic > going through my mom passing away was the hardist thing in my life and it has prepared me for this day .But im still worried/skeered no clue how to take care of a 18 month old and a pregant GF being homeless :'(

If you get thirds isn't that 40 g's?  I'm obviously missing something so I suggest you look into squatter rights.

mattm i just read about them(squatter rights) basically it says until the deed is in her hands i could stay here ill bring that up . I wish it was 40g after the bank and hospital, court cost, lawyer fees, get there's i may walk away with 15g>i just hope its fast i mean if that money goes into the estate they don't just pay off who is owed then put what is divided on a back burner for 30 days 60 days ????

I know it doesn't help your situation at all but the easiest way is to take care of all this stuff while their still alive.  All the property was split and signed over to myself and my sisters and my parents actually didn't own anything even the house.  This way if some illness comes about and huge doctor bills there is no estate for them to come after.  my mom is actually living in a house I own.

any chance the new owner would be willing to rent to you ,at least until you get your money and can buy your own house.

That is the extremely smart way to go. My parents live in the house I grew up in and that I now own. They also have a summer place that my brother and I jointly own. So when and if they are sick and need care, their estate is penniless. All of their life's assets are in a trust that my brother and I are due to inherit.
