My guess is that reputable lawyers won’t waste their time on cases that don’t qualify because the attorneys don’t get paid if they don’t win. The state recognizes this and possibly believes the lawyers more often because they turn in proper paperwork that has been verified. The people who approve the disability claims are more than likely swamped and won’t spend the time needed to verify claims submitted by individuals that in a lot of cases are fraudulent. They depend on the lawyers to weed out the fakers. I have no information to back up my theory, but it seems like a logical conclusion. Yup ~ I totally get that. And if that's what it takes to get the folks that need , have earned and deserve these benefits, then so be it. So I have no problem with paying a professional for their time. But IMO for 25% of the back benefit $$$ or 6K whichever is less (law sets this), Old Perry Mason better be standing on his HEAD ! A-Jay
Super User Scott F Posted January 13, 2024 Super User Posted January 13, 2024 I had no back benefits due so mine was for only the first month. $6,000 is a lot but compared to the amount you are going to get, it is sure better than getting nothing for the back benefits and all the benefits going forward. 1
Super User A-Jay Posted January 13, 2024 Author Super User Posted January 13, 2024 Possibly - waiting for regular SS benefits isn't really an option. Sadly statistic show that only a small percentage of folks dealing with what we have here, live to the minimum age of 62. Combined with quality of life, time becomes a precious deal. A-Jay
Super User GaryH Posted January 13, 2024 Super User Posted January 13, 2024 There is so much I want to say but how mad I am I know I’d be booted. Two people who devoted their lives to serve their country and can’t get what is deserved is BS. Andy I sure hope and pray that you guys can get what you deserve in a fast and timely manner. 2
Super User A-Jay Posted January 13, 2024 Author Super User Posted January 13, 2024 Thank you my friend ~ It's all good. It will work out, one way or the other. All the $$$$$$$$ in the world can't replace quality time together. And right now we're having some and we're enjoying every second of it. A-Jay 9
Super User MN Fisher Posted January 14, 2024 Super User Posted January 14, 2024 I notice that Tank and Kya are keeping a close watch on Lynn....they know... 1
Super User A-Jay Posted January 18, 2024 Author Super User Posted January 18, 2024 Follow up & closure on this one ~ Just found out Lynn is not qualified for SSDB because of "the 5 year rule". Look it up before you need to. Wish we'd known. https://trulaw.com/legal-guides/social-security-disability-insurance/what-is-the-social-security-disability-5-year-rule/ I'm done here. #bummer A-Jay 1
Global Moderator 12poundbass Posted January 18, 2024 Global Moderator Posted January 18, 2024 Well that’s a bunch of……
Super User slonezp Posted January 19, 2024 Super User Posted January 19, 2024 Have you called a lawyer that specializes in disability? or only consulted the website? Can you get disability from the VA? I am disabled by definition with the Americans with Disability Act. I got injured at 42 and was told by the comp lawyer, in the state of IL, it's almost impossible to collect it under the age of 50...12 years later I'm still working 50 hours a week. My ex wife has been on SSDI since her mid 20's. She was diagnosed with bi-polar disorder. Or, as I call it, alcoholism. Hasn't worked a day since we divorced. Collected child support from me for 14 years for 1 kid plus whatever the state gave her. Also collected SS for her other kid after his father offed himself. Her father bought a condo, turned it into section 8 housing, rented it to her and got his mortgage paid by the government. And it's people like that, why the honest folks get the short end of the stick. 2
rgasr63 Posted January 19, 2024 Posted January 19, 2024 Mr AJay You need the lawyer and he will get you into the court loop. But you also have a federal congressman that can bring your case up faster if he will make an inquiry on your behalf.

We waited too long to apply - 5 year rule is not negatable apparently. https://trulaw.com/legal-guides/social-security-disability-insurance/what-is-the-social-security-disability-5-year-rule/ But thanks. I am no longer responding to replies here. Too depressing. A-Jay 1
