Well my wife volunteered to climb up the tree and hand saw it. I did get permission from the neighbor whom was going to trim their overhanging tree onto our property last year but it never happened. Talked to her new husband in may and he said he was to busy to cut the tree so i told him i would do it with his ok. He was fine with that agreement.

 

Lazy people as neighbors, their whole front yard is overwhelmed with 3 different types of trees all growing branches into each other and flopping over and drooping down into my yard. I did trim the neighbors tree in 2020 that was in my way and the lady whom was not married at that time chewed my hind end off saying why didnt i ask her permission? I told her because the law states if i stay on my property and cut your impeeding branches i can legally cut them.

Plus we dont like each other from past experiences with her fence line which 1 month after she had a fence put up the contractor had to come and tear it down because they put it in my yard by more than 2 feet. That killed my relationship with her. She wasnt married at that time and stated to me she doesnt like me and doesnt want to ever talk to me after i went up to her and told her her new fence was on my property and she got jacked over that and has hated me since.

I've experienced this issue before too.  Over hanging branches are not the responsibility of the owner where the tree resides.  At least here in MN that is the case, because I confirmed.  The issue is if the branch falls and causes damage, like if it hits your house or roof.  The owner of the tree is not at fault.  That being said, I have always trimmed branches of my trees so that they did not cause a major issue with my neighbors.

 

I think its generally just a good idea to discuss these items with your neighbor in advance and come to an agreement.  It sounds like you already tried to do this and didn't work.

 

It looks to me like your wife is up there barefoot?  That's ballsy.  I would at least be wearing shoes lol.

Neighbours ?!

I solved that problem myself two years ago. I now have 25 acres and can’t even see my neighbours, and the ones closest to me are fantastic even if I could see their house. Unfortunately your place is only as good as the neighbourhood it’s in. Hope it all works out for you.

Ha ha I've watched Judge Judy try these cases before.

It's obvious that the Land owners trees cannot comphemise the livelihood of adjoining properties but you cannot trespass,  only trim invasive limbs.

 

We live in a remote area and have not experienced this scenario.

I’ve got giant pine trees in my yard, anyone is welcome to cut any amount of them down anytime. Please and thanks
