Mo_Tick Posted August 16, 2005 Posted August 16, 2005 i bought this Landau 1447 2 months ago from a Kid (23). it was a good deal 300 for boat, 4hp merc, Trolling Motor, wide 100 FF AND TRAILER. the trolling motor ended up not working so i called the guy and he gave me 50.00 back. so ive got 250.00 in the deal. now i got the Title on the Trailer. and was waiting on the title for the Boat. he sent it and its not the title for the boat he sold me. he said it was the one he got with it. the year on the Title is 64' and i know its a 79' serial # wrong vessel # wrong its not for this boat. my plan was to use it, fix it up and sell it in hopes of turning a profit and getting a bigger better boat. with out the proper title i cant do that. what should i do? at this point i just asked for my Money back and for him to come get the Boat. can i file for a Title for this boat with the serial # from Landau? any thoughts? gamblerOH Posted August 16, 2005 Posted August 16, 2005 In ohio if it was made before 1998 and is less than 15 ft. it doesent need a title. The DMV makes a registration when you buy your license thats all you need. You should be able to call you DMV and give them the vin# and file for a lost title. Quote
Muddpuppy Posted August 16, 2005 Posted August 16, 2005 In Texas you would need to go through the Parks and Wildlife Service for a new title. I think there may be a cut off point when it comes to age if I remember correctly. There also maybe a size limit but here the motor has to be registerd also. The trailer would be able to be handled at the DMV. I read on TP&W site a while back that they are going to crack down on missmatched titles, non existant titles ect. due to the amount of stolen boats. The way it sounded it could be rough if you didn't try to straighten out a problem and were caught. That would just be here. Quote
Super User Sam Posted August 16, 2005 Super User Posted August 16, 2005 In Virginia you would contact the Game and Inland Fisheries to research the title. If the boat was stolen you will lose the boat to the law enforcement authorities. If the boat was not stolen then you should be able to obtain another title. Be careful!!!! Quote
Low_Budget_Hooker Posted August 17, 2005 Posted August 17, 2005 please be sure to follow up on this post. I am very curious to know what was required. I bought a 64 w/ no title and wasn't going to register it till next year. Thanks in advance Quote
Super User Gatorbassman Posted August 17, 2005 Super User Posted August 17, 2005 The first thing you need to do is call the guy back and get a noterized Bill of Sale. This should take the place of the title in most states. If it ends up the boat was stollen then that just stinks. Quote
BASSMAN1301599783 Posted August 17, 2005 Posted August 17, 2005 Most places you can apply for a new title. It costs 15 bucks around here and they issue you new numbers and everything. But you might have to take your boat to the DMV. Or you could say you built it and have them issue a vin number. My buddy did this. Quote
Mo_Tick Posted August 17, 2005 Author Posted August 17, 2005 Here is the Bigger Problem. In Mo its my understanding i have to have a Title on the trailer, boat and Motor, the Bill of Sale will work for the Motor. The Title that this young Man gave me, He actually had to do a lost title search to get it. and its the one he got!! untill i brought it to his attention that it was all wrong , he never knew. the reason he never checked was it was registered with new MO tags and numbers till 05' when he got it., now i have to register it and its a problem. i have a gut feeling that he is a good Kid and has no idea about the boat. i dont know where he got it but i am going to call the DVM today and will post my Findings. as it stands now, i have stopped working on it, and we are going to exchange back the money for the boat. i am keeping the Motor and fish finder because they werent working when i got it but are now after i tinkered with them. Quote
gamblerOH Posted August 17, 2005 Posted August 17, 2005 Sounds like he's getting the shaft. You're keeping the motor just because you got it running and in you earlier post you made him give you back 50 bucks because the trolling motor didnt work? In my opinion the trailer would be worth $250, as long as the boats not stolen i'm sure the DMV will work with you. Quote
Mo_Tick Posted August 17, 2005 Author Posted August 17, 2005 Gambler, he offered it to me first, and anything else i wanted off the boat before he took it back!! so i dont feel that I am giving him the shaft. i just talked to the MO State Patrol and the DVM office in Jefferson City. DVM says i cant get it registered without the proper Title, and to do that, we need to find the Orignal title for the boat and who its registered to. State Patrol thinks there is something wrong, and want to do a vin search to see if it was stolen. if it is stolen, I GOT THE SHAFT NO MATTER WHAT!! Quote
Mo_Tick Posted August 17, 2005 Author Posted August 17, 2005 more info. it appears the vin# on my boat is registered to another person that has a few other boats as well. the vessel # on the title i have is the one from the guy i got it from, the vessel# on the boat hasnt been renewed since 1990. so, the we think the guy he got it from gave him the wrong Title. now we have to find the person that is on the Title and have them sign it over or whatever, in order to get the right Title to me. then the one i have has to go to whom ever has that boat. a big mess, but so far, its not a stolen boat or anything like that. DVM can look up a boat title by the Vin number, and tell you whos name it under now, the dang thing is, since i am not on the title (yet) i cant get any of this information, even though i've paid and have a bill of sale. none of that matters, its whos on the title. gamblerOH Posted August 18, 2005 Posted August 18, 2005 Dont get the wrong impression, I didnt mean you were intentionally "shafting" him. I guess what I meant was that he is shafting himself by not providing the proper paperwork. I just could not understand why he felt like you should keep the motor and get your money back too. I hope you can get this all worked out for both parties sake but it sounds like its going to be a lot of hassle for you both. Quote
Mo_Tick Posted August 18, 2005 Author Posted August 18, 2005 well i agree, its a big hassel. but please understand i am working off the price that i purchased the stuff for. with no regard to its "REAL" value. thats why i bought it. a little tlc and this thing would double or better my money. i paid 250.00 for the whole thing, then the Motor isnt worth in this case its real value of (150.250) its worth is relative to the price paid. i think we are going to work it out, we have to, if i gave it all back im out some cash for what i have already done to it. will keep all posted. Mo_Tick Posted August 19, 2005 Author Posted August 19, 2005 well heres the Deal. If you have purchased a boat with no Title, you must get the Last known registered owner to give it to you. this is a MESS. but in MO to get registered i have to have it, i could have kept my mouth shut i guess and did it with the wrong title but thats not me. the guy i got it from now has to contact the guy he got it from, and so on until the title is found. the state even though they have the name and address cannot give us that info, nor would they contact him for us. A MESS. if we cant get the title then after all this (plus the work i've allready done on the boat) it will be one of those boats you see sitting at a pond on someones farm. i hope this works out, and none of you go through it. Hookhead Posted August 19, 2005 Posted August 19, 2005 I feel for you tick, I HATE title hassels. The fact that one tiny piece of paper can ruin your plans totally sucks. I just bought a mail order boat trailer for my 12ft aluminum. To get it registered here in CA I need a receipt (to show I paid taxes) and a signed M.C.O. (Manufacturer's Certificate of Origin). The MCO did not come with the trailer. > Quote
Mo_Tick Posted August 19, 2005 Author Posted August 19, 2005 you would think i'd learn. i went through that too in Kansas. MCO was not found and Kansas is not clear on the law. we thought we didnt need a tag, and for 5 years didnt. for some reason we needed something, and POOF!! 5 years of Back Taxes and needed the MCO. in Kansas its GVW on the trailesr not the lenght.
