If you receive an email purporting to say that there is a 10% tax on fishing equipment and supplies it is not true.

 

I checked with someone in the fishing industry that sells high end rods and reels and he said Cabela's made a mistake charging their customers a 10% tax for Obama Care and there is no 10% on anything fishing.

 

If anyone out there knows anything about this situation please feel free to add your comments.

 

Here is the email that was sent out. I don't think the photo will make it but you can read what it says.

This is an image of a sales receipt from Cabela's, a popular sporting goods store with almost 50 locations throughout the US .

The 2.3% Medical Excise Tax that began on January 1st is supposed to be "hidden" from the consumer, but it's been brought to the public's attention by hunting and fishing store Cabela's who have refused to hide it and are showing it as a separate line item tax on their receipts, the email states.
I did some research and found directly from the IRS's website information that PROVES this to be true and an accurate portrayal of something hidden in Obamacare that I was not aware of! Now being skeptical of this I went to the IRS website and found this!
Q1. What is the medical device excise tax?
A1. Section 4191 of the Internal Revenue Code imposes an excise tax on the sale of certain medical devices by the manufacturer or importer of the device.
Q2. When does the tax go into effect?
A2. The tax applies to sales of taxable medical devices after Dec. 31, 2012.
Q3. How much is the tax?
A3. The tax is 2.3 percent of the sale price of the taxable medical device. See Chapter 5 of IRS Publication 510, Excise Taxes, and Notice 2012-77 for additional information on the determination of sale price.

So being more curious I clicked on "Chapter 5
Of IRS Publication 510."

And what do I find under "MEDICAL DEVICES" under "MANUFACTURERS TAXES"?

The following discussion of manufacturers taxes

Applies to the tax on:

Sport fishing equipment;

Fishing rods and fishing poles;

Electric outboard motors;

Fishing tackle boxes;

Bows, quivers, broadheads, and points;

Arrow shafts;

Coal;

Taxable tires;

Gas guzzler automobiles; and

Vaccines.

He saying there is an e-mail going around indicating it's true, when in fact there is no such thing.

It's folks in opposite factions, like political smear campaigns. Most likely a animal rights group

I know and understand that,its all good.

 

My statement was comedy more than anything. I got that email in Dec 2012, and debunked it when I went to cabelas 2 weeks later.

 

I was surprised when Sam posted it, as I had seen it so long ago, and I found it funny.

Sport fishing tax: http://www.irs.gov/pub/irs-pdf/p510.pdf Page 31 its there. Its probably a hidden tax that the store pays when purchasing from manufacturer then in return price goes up to the consumer for the retailer to cover it.

 

 

It doesn't say the retailer pays for it per this quote: 

 

"Fishing rods and fishing poles. The tax on fishing rods and fishing poles (and component parts) is 10% of the sales price not to exceed $10 per article. The tax is paid by the manufac- turer, producer, or importer. " 

 

 

The IRS has another page on their site that will define who pays it. It will not always be the retailer (in the tax code retailer can fall under importer) , beside the tax is base on percentage of the sales price, marking the price up just raises the tax liability..... Federal excise tax is nothing new. Everything, whether it a product or currency, has tax stipulations to it. Local, state, or federal... Hell, the IRS says if you find a $1 bill on the sidewalk, that should be added to your gross income. Seriously.

The excise taxes you are looking at are the result of the Dingell-Johnson and Pittman-Robertson Acts.  These have been around for longer than most of the members here have been alive.  P-R Act was started in 1937 and D-J Act came into being in 1950.  The revenues generated by each of these taxes are used by the federal government to fund federal fish and wildlife programs as well as being disbursed to the states based on license sales.

Several months ago I noticed on the bottom of a Cabelas recipt that there was a line added concerning Obamacare.  It didn't indicate that there was an additional tax applied but that an amount of your taxes would be used for that purpose.  Kind of caught me off guard because it did look like an additional tax until I looked closer.  I don't know if this was just our local store, Cabelas wide, or an angry employee with access to the computer?//  This was also about the same time my son who works there had his hours cut in half so as to be excluded from the new law.

So basically the spammer who created the hysteria used the excise tax information in place of the medical device tax information??? Well even though theres now some truth to the email the best truth is we arent paying the tax!
