So a driver pulling out of her driveway Sunday. Destroyed the back end of my Denali Envoy, as well as ripped the side up on my cousins car, and removed the front end from a 12 yr old Camry. Now her insurance company wants to play games over said SUV. There adjuster called my wife today and told her that he doesn't believe there will be enough money to pay for the repairs, rentals, and what have you. So we should probably just file it with our insurance company. Then proceeded to be quite rude to her. The Hell you say. I call up there twice and can't get him to return my call. I talked with another person up there who explained somewhat what's going on. He said the adjuster is still waiting to hear from one of the other parties involved, before he can make his decision. Mean while my wife and son are driving a wrecked SUV that is making clicking noises with a messed up fuel gauge and rear end. I tell you what, this is ridiculous. Tomorrow Mr adjuster is getting the bill for the luxury rental car my wife and child will be riding in until ours is fixed. I expect equivalent of what we have as far as rentals go.

People just baffle me. Your daughter destroys her 2013 SUV which is valued around 46000. You and your wife are driving 64000 dollar plus cars, and the best you can do is bare minimum on liability insurance? I bet that and the dads snippy attitude all change when my attorney takes it all from them. Heck his wife ain't bad looking, and was giving me flirty looks during the whole ordeal. She said she watches me mowing the yard at my Grandmoms house. Probably cause I dance while riding the lawn mower. She can pay me then. However I'll be danged if I have to cough up a bleeding cent for this.

You do not pay her insurance company - make the company you pay your hard earned money to, do their job.

 

 Get any and all money from your own company and let your insurance company deal with all the administrative matters.  

 

I will not ever speak to any other company other than the one I pay and I refer all matters to them.  That's their job.

 

Otherwise, what are you paying them for ? ? ? ? ?

 

Time is money and you spent yours so that if and when this happened, you have already paid for someone else to deal with this in advance.

Sad to say, but sounds like you need to involve an attorney, if you have not already. I had an issue regarding an accident that happened about 12 years ago, Insurance company pulled the same crap it sounds like you are doing. I asked for roughly 7 grand to cover damage to my vehicle, and pay my medical bills. Had to file suit, company paid over 35 grand to settle a 7 thousand dollar claim....NOT including their costs.

 

Hated to do it, Really hated to do it because in the end, my attorney and their attorney made a bunch of money, I got some, and all of our insurance rates suffer because of it.

 

As per A-Jay's comment above, my company actually gave me the highest dollar amount they could for my vehicle...about 1800 bucks above NADA because it was in impeccable shape....their words. They did this because the folks at the other insurance company were so unbelievably rude.

He's already working on it. That's who told me to get a rental and bill them for it. I'm getting him the rest of what he requested tomorrow. Then we wait.

Was a police report filed??

I forgot about that part of the story. Oh and yes one was filed.

Anyway. The officer put our names on the report wrong. It is being corrected as we speak. Apparently I am none other than General Robert E. Lee. Honest to God. He put my name as Robert E. Lee. My wife is Mrs Mary E. Lee. I can't make this up.

Ha!! Well Mr. Lee, was your neighbor found to be at fault? If so, like Ajay said, only deal with your own insurance company and make sure you get exactly what your policy will provide!!

That murdered out E55 AMG I looked at a few weeks back. Would look mighty swell with me driving in it. ;) Even more so if I can get her a matching one. Stupid attorney has me pipe dreaming now. Really though I just want my dang Envoy fixed.

Yup. As the only person operating a vehicle at the time its all on her. I hope this doesn't get nasty. I have to work across the street from these people every Weekend at my Grandmoms.

I'm fortunate the last few mishaps I've been involved in, the other partys had good insurance. I carry un insured and under insured on my policy for occasions you speak of. Good luck

Sounds all too familiar.  We were going through a parking lot and a kid didn't look, and backed into the left quarter panel.  We exchanged all the info, and brought my wife's car to the body shop.  He told us that because it was the other driver's fault to let our insurance company pay for it.  There is no deductible in that situation, because they are entitled to go after the other driver/company for full repayment.

 

 In return, we signed a subrogation agreement which allowed our insurance company to go after the other company and/or the driver.

 

Never had a contact with the other company.

several years ago someone took off from a stop sign squeeling tires and smashed into the front passenger side of my old dodge neon. tried to go through the guys insurance, they even came out and looked over the damage to get an estimate. then referred me to an agent who no longer worked for the guy who hit me insurance company. after a couple voice mails with no return call or hearing nothing, i finally got ahold of someone else in the insurance company, explained everything. a few days later get a letter in the mail saying they arent paying for any of the damages and have dropped the insurance policy for the guy who hit me. turns out, he was living in VA and his car was registered in MD to avoid the taxes, emissions, and inspections. so i contacted my insurance company and explained the entire situation. they took care of me under a part of my policy for being hit by uninsured motorists. they ruled my car totalled, damages worth more than the car. paid me the full amount the valued the car at. told me they would go after the guy who hit my car and his old insurance company to get theirs. and that he would probably get in trouble with the county for back taxes, etc. It was night and day dealing with his insurance company to dealing with mine. my point is, as other people have said in this thread, contact your insurance company asap and explain whats going on. they will get it taken care of for you, and promptly from my experience. i only wish i had contacted my insurance company right away, but it did teach me a lesson. i used the money my insurance company gave me and bought some parts from the junk yard and fixed my car so it atleast looked decent and wasnt all smashed up, i had money left over in my pocket and helped my mom get some tires and a front end alignment on her van...

 

if its not your fault, your insurance company will/should take care of you and go after the other peoples insurance company, and your insurance rates shouldnt go up because of it either...

I have a great State Farm agent who I have worked with for 16 years. Prior to that I was with

the compny in Denver for 17 years. My agents have been professsional and the compnay

has always been helpful and responsive. My advise is to get in touch with you local State

Farm agency and work with a local representative you have met nose to nose and toes to

toes.

In 50 years on the road there have been accidents, it's always worked pretty simple with no fault insurance.  My insurance company paid my damage and if the other party was at fault my deductible was waived and the insurance company settled with the other insurance company.  As far as a rental car, there are terms in my policy of what the insurance company will pay for, anything up and above that is up to me to cover the difference.

 

Agents write a policy and can be helpful when submitting a claim, but they make no decisions, it's up to the adjuster and the terms of the policy, it's a contract.
