Hyrule Bass Posted February 6, 2013 Posted February 6, 2013 i would just move on and chalk it up as a lesson learned. its not worth the effort. as far as him accusing you of stealing, if he didnt file a police report, then i wouldnt even worry about it. just dont list him as a reference or prior place of employment when applying for your next job. sure having that money would help, and it sucks to get screwed out of what youre owed, but sometimes you just gotta take a bite of that big ole crapburger and move on...as for the key, i wouldve gave it back to him the minute you were terminated from there, or take it back asap and avoid confrontation... Super User Fishing Rhino Posted February 7, 2013 Super User Posted February 7, 2013 I doubt you'd get far in any type of court. The doctrine of "clean hands" will prevail.  In the matter of your pay, you knew that you were not paying taxes on that "income". Nothing was deducted for federal, state, and social security taxes, as prescribed by law. The court will view you as a co-conspirator to evade taxes. As soon as this comes to the judge's or magistrate's attention, your case is toast. And, depending on their mood, they may refer the matter to a tax enforcement bureau. If his employer argues he a "contractor" then the original poster will not get in trouble for anything...well, neither one of them would tax wise..(People defer tax payments all the time.) Which is why I was asking if a condition of employment were signed stating wages, etc. My bestfriend works as a contractor and he has a stated contract for payments, so if his clients fail to pay him then he got the contract to use against them. I've always had to sign something when getting paid by business. I presumed Lunk has covered it with good professional judgement in the PM. Quote

I'm a contractor also but I let my CPA handle all this now so I'm not real sure anymore. In regards to the estimated quarterly payments, when I first started contracting I had no idea about this so I didn't pay any that first year. It was no big deal, when I filed taxes at the end of the year I just paid what I owed all at once and there was no trouble over it so you could go that road and say you didn't know. I think quarterly payments are required now but at the time I started I saw it as mostly a convenience thing so you weren't blindsided all at once at the end of the year with a large amount owed since you would have paid in as you went and had part of it already covered.I'm getting hit hard this year, even with quarterly payments. Made too much. Now gotta pay the piper. Quote

Some of these posts are treating this situation like a VP from Exxon having a dispute over his golden parachute.  It may be a significant amount money to Scorcher but in reality it's small amount of money. Not that case like this would ever see a courtroom but if it did only the question of what is owed or not owed would be dealt with, the tax issue would not be addressed at all.  I'm waiting for Car Wash with Richard Pryor to come on TV, put this situation into real perspective..lol.  Sounds to me like some may be perfect candidates for employment with the IRS as auditor, the most feared person in the world.
