scrutch Posted January 16, 2013 Posted January 16, 2013 Last summer I bought a Berkley night fishing light from Walmart and took it to the lake that night. It was the fluorescent type that had a black light and a white light. It had two suction cups on the bottom for sticking it on the gunwales. I got to the lake, took it out of the box and plugged it in. It worked good and I used it for a couple minutes before we decided to motor to another spot. I turned it off, pulled it off the gunwale and laid it upside down on the front deck of my bassboat. After motoring about a quarter mile, we smelled that dreaded electrical fire smell! I stopped immediately to investigate and found that my brand new fishing light on the deck of the boat was in full meltdown mode It was laying upside down and when I turned it over there was a melted spot on the light and a two inch diameter melted hole in my boat carpet! I called Berkley the next day and after some time spent emailing pictures and getting estimates ($1300 to replace my carpeting), I accepted a reparation offer totaling $850. They mailed me a check for $500 and gave me $350 worth of product from any of their product lines. The pic shows the $350 worth of product I chose. So thanks to Pure Fishing for standing behind their product and not forgetting the "little guys" of the fishing world!

The product's value is approximately 50% of retail if not less so for them to give you $350 of product means they actually gave you around $175 of product at their cost. If the damage was $1,300 then they should have settled with you for $1,300. However if you are happy with the settlment then we are happy for the settlement. 5
scrutch Posted January 16, 2013 Author Posted January 16, 2013 Those are D&S cranks. They claim to go 20-28 ft. deep and I like the single hook design to reduce hangups (I hope). I have a few spots that are fish magnets but just eat up cranks because of the deep laydowns. These are all baits that I've wanted to try but just haven't yet. I've been pretty impressed with sebile's story and innovative design. We'll see how they perform. The other cranks are additions to my cold water arsenal. Flatt shads and spin shads. Oh, and Jeff, the boat carpet will probably get replaced this spring.

Also how's the carpet It didn't catch fire, but it probably would have if I would not have unplugged it right away. It has a melted spot on the top where it melted the hard plastic that was about 1/8 inch thick. I sent it back to Berkley for "forensic analysis".

I like the black light for summer. I think it would have helped keep the skeeters away. I never really got a chance to give it a real test though.

Well the quote was for replacing the carpeting in the entire boat. The damage is a two inch melted spot on the front deck. The carpet is not exactly brand new either. It looks new but it is used. I thought it was a good settlement considering those facts. Pushing for more money would have made me feel greedy.

I gave the Berkley rep a list to go from and told her that when she got to $350 to just stop. She sent me EVERYTHING on the list.

A corporation must be represented by an attorney and at their hourly cost it is less costly to settle than go to court or answer any legal correspondence. As stated previously, if you are happy then we are happy.

The question is this, can you get your carpeting looking exactly the way it was before their defective product caused a burnt spot for $500. If so or the spot doesn't bother you,you did ok. If not the full $1300 for carpet replacement would have been more in line. The lures, regardless of the retail value are basically a goodwill move. As Sam says 50% of retail, IMO probably no much than $100 in their cost, besides how much could you resell those lures to help in the cost of carpet replacement, not to mention the inconvenience in doing so. Would a case like this go to court, probably not but if so you being the plaintiff wold probably have to file papers in their jurisdiction, meaning you travel there or get an attorney to do it for you. Even if you win, you still have lost considering expense and travel. I think Pure Fishing got off for $600, no more than $700 and you got a hole in your carpet.

Find a carpet that is an acceptable match and buy a small piece, or remnant if you can. Place it over the damaged area, line up the nap, and secure it in place. Small screws or brads should work. Use a straight edge and a sharp utility knife, and cut through both carpets. You might need a few passes with the knife to cut cleanly through both pieces. Remove what you used to hold the "patch" in place, then set the patch to one side, keeping its orientation the same. Remove the damaged piece, and clean any remaining adhesive. Apply carpet adhesive according to directions, then fit the patch into place, and use something like a wallpaper roller and press the patch securely into place. To give it the weathered and worn look of the old carpet, scuff it with a wire brush until it's has the slightly worn appearance of the existing carpet. It's not likely that you'll get a perfect match, but it will be preferable to a crispy melted area, and will only cost a few bucks and some time. 1

As stated previously, if you are happy then we are happy. Pure fishing already has a legal department. The last thing they want to do is get in a legal battle because it is bad with PR. Hence why they gave him the free gear. Pure fishing could have had this case wrapped up in court for years if they wanted to .
