I sold a steez rod back in decemeber. Fully packed wrapped in bubble wrap and shipped in PVC.

 

buyer profile said Romainia, so I asked where I am shipping it.(I wont ship rods out of country) He gives me a New York address.....Rod delivered on dec26.

 

Buyer now files claim saying rod is broke and tip guide is crushed.......got my paypal account froze too, since I have a negative balance because of the claim.

 

"Apparently" the buyer had rod shipped to Europe and just got it.

 

I don't see it as my problem and now I ticked........buyer claiming tube in perfect condition, and I shipped him a broke rod.....waiting on ebay response to claim.

 

GRRRRRRRRRRRRRRRRR!!!!!!!!!!!!

The way that Ebay and Paypal works is like this. As long as you shipped to the confirmed address on the buyers Paypal account, you have some protection. If his Paypal address is in Romania, and he gave you a NY address, and that's where you shipped it, your screwed. This is a common scam on Ebay, as the scammer knows that if you, the seller, ship to the address not on the paypal account, there is no recourse for the seller. If his confirmed Paypal address is the NY one, and you have some sort of proof the rod was shipped overseas, then you can make a case with Ebay and Paypal, and most likely win. If you don't have proof, try emailing the buyer, thru the Ebay system, and in a roundabout way, see if he had the rod shipped to Romania from NY. If you can get him to admit that, Ebay has access to the messages n their system, and you will win the case. Good luck, and sorry you got scammed and have to waste your time on this loser.

Maybe you can use the dec 26th delivered date, and the fact that the case was opened 3 weeks later as evidence that it was shipped overseas.

I have made it clear his paypal confirmed address is the New York address, the address I shipped to. and that the buyer had it shipped to Europe....I also stated that since my auction stated USA shipping, the buyers shipping to Europe before filing a claim is a breach of contract as contained in and by the auction.

 

either the shipping company or customs must have opened the tube, neither of which is my, the sellers, responsibility for the fact the auction stated USA shipping.

Make sure you let ebay know that the buyer has communicated thru ebay messages so they can look thru and see he had it shipped. you will win if they look at that.

i'm rooting for ya and hope paypal/ebay does the right thing b/c you are clearly the responsible person here.

 

keep in mind you can pull the "if it's broken then return it" card.  the guy will likely fold before shipping it back.  tell paypal no returned rod, no money. he can't have both.  if it is indeed broke you can at least send it back for a new one

I hate that this happened, it just makes me so sick that people do stuff like this and Ebay and Paypal have you temporarily frozen. I hope EBay and PayPal doesn't take too long getting this resolved for you. In my opinion you did do everything that a seller should do.

Did eBay give you a timeline on how long this would take to resolve

That is the address of a "reshipper", a lot of people overseas buy things in the U.S., and use these reshipper services to get around the no overseas shipping many sellers don't want to do.

I got scammed once on TT.  Throught he power of the internet I found out details about his work, home, and parents. 

 

Needless to say, I got my money back. :)

I wondered about the address too, but I ship stuff to my work all the time, so I figured it was that......next time I will know you can bet that.

I am really hoping the whole "buyer shipped to Europe" works. It should but you never know in todays world. 

 

I cant send it back to Diawa, even if I did get the rod back cause I am not the original owner. At least that's the way I always understood it to work.

 

there is no way the tube isn't damaged (as he state) yet the rod be broke.

My theory all along is he had a rod just like it that he broke and sent pictures of that rod to show something broke and is trying to get a free rod. I know its a stretch but I don't trust very many people.....OR he actually lives in new York and has had the rod for 3 weeks and has broken it and now wants a free rod.

 

Ebay has given me no timetable but I venture to say it will be 1-2 weeks.

I called ebay about the timeline. Looks like you got to wait 7 days (jan19) to try to work it out between buyer and seller. THEN if not resolved, it gets escalated and eBay make the final decision in 72 hours...... I asked the customer service person on the phone can I escalate now, she said yes, so that's what I did.

 

I spoke to Ella, reference number 1-***********.

 

so we shall see in 72 hours.....

1st email

 

"The rod the buyer paid for was shipped on Dec 17,2012, fully as described and all handles, blank, and all guides were intact and in great condition. USPS#03113260000222594831 Rod was attempted delivery on Dec 22 and picked up on Dec 26.

Buyer waited 3 weeks to file a claim from the date it was delivered to supplied address. buyers profile said Europe,I asked where I am shipping to.

I did not and will not ship out of the USA. Buyer apparently had Rod shipped from New York to Europe.

Seller can not be held accountable after it left New York. Again, I stress, the rod was triple checked before listed on Ebay and triple checked again before shipping.

Rod was fully as described and fully complete and intact. Rod was shipped, wrapped in bubble wrap and in a PVC tube.

I have almost 200, 100% positive feedback, both buying and selling. This feedback is spread over SEVERAL Ebay members over several years. between the buyer weak feedback and shipping shenanigans, I the seller feel scammed. "

 

2nd email

 

again I want to stress I shipped a fully intact and useable rod. All handles, blank, guides, and tip were attached as they would be if bought from a store. USPS tracking:03113260000222594831

My auction states I ship to USA only. Buyer shipped rod to Europe, which I find a breach of the auction rules. While shipping to Europe, either the shipping company OR customs very likely have opened the package and broken the rod. Neither of those is the sellers responsibility as the auction stated USA shipping only. I hope ebay, the great site it is, reaffirms my faith that rules still matter and the buyer broke the rules contained in the auction contract.

 

 

3rd email:

 

I escalating this case for the fact I am not in the wrong. I shipped to the address provided in a safe and secure way.USPS tracking:03113260000222594831

Please check the 2 messages I sent this morning through the resolution center and ALL messages between the buyer and myself.

The buyer has broken the terms of contract contained in the auction and I can not be held responsible for the product after it left the paypal verified address.

This claim has locked my paypal account and I hope for a quick decision. I also hope the eBay center sees the seller (me) has done everything I can to provide the product to supplied address in a safe undamaged way.

I stress again, when the rod was packaged it was unharmed and undamaged, ready to fish. I can not be held accountable for unknown shipping methods used by the buyer. Shipping methods, that are not covered by the rules of the auction, both in method and location.

 

please check all messages, as the buyer admits and chose himself to ship the rod to Europe, not the seller.

You have a good case against them, but it sucks they have had your paypal locked this long. Even when it's clearly the buyers fault, they are dragging it on.

 

I think you should win the case, but in general they side with the buyer.

With that much evidence you should be fine. eBay is good at dealing with problems. Just in their own time.

I say "locked"........but I have a negative balance, since they took the $260 back out of my paypal account.......If I went to buy something through paypal you know they aint letting me pay for it until I take care of the balance...so yeah, it might as well be locked.

 

I would sure think I have a good case, but you never know in todays times....

 

 

since I went ahead and escalated it , it should take 72 or less. (eBay's words)
